Age Discrimination

Age Discrimination Lawyer in Oakland

More Than 65 Years of Collective Legal Practice on Your Side

Age discrimination often appears as a pattern rather than an open statement about age. An Oakland employee or applicant may see strong performance reviews turn negative, lose advancement opportunities, receive unfavorable assignments, or be selected for a layoff while younger colleagues receive different treatment.

One event may not tell the full story. Timing, shifting explanations, age-related remarks, compensation changes, comparisons with younger workers, and replacement by a younger employee can reveal a broader pattern.

Call (925) 332-1444 to discuss suspected age discrimination with our employment law attorneys.

How California & Federal Law Protect Workers 40 and Older

The California Fair Employment and Housing Act protects applicants and employees age 40 and older from age-based discrimination and harassment. It generally covers private employers with five or more employees. The federal Age Discrimination in Employment Act provides similar protections and generally applies to employers with at least 20 employees.

These laws can apply to hiring, firing, compensation, promotions, training, layoffs, benefits, and job assignments. A claim may involve direct age-based treatment or a neutral policy that disproportionately harms older workers without an adequate explanation unrelated to age.

Workplace conduct that may warrant closer review includes:

  • Hiring: A qualified older applicant is rejected while substantially younger candidates advance.
  • Performance reviews: An established employee receives sudden criticism that conflicts with prior evaluations or documented results.
  • Promotions: Advancement opportunities repeatedly go to younger workers with similar or lesser qualifications.
  • Layoffs: Older employees are disproportionately selected while younger employees remain or assume their duties.
  • Termination: An employer gives changing reasons for discharge or replaces the employee with a younger worker.
  • Harassment: Age-related jokes, stereotypes, or exclusion contribute to a severe or pervasive hostile work environment.

Retaliation is a separate concern. Reporting suspected bias, opposing unlawful conduct, or participating in an investigation may be protected activity, depending on the circumstances.

Evidence That Can Reveal a Pattern of Age Bias

To evaluate a possible claim, we consider who made the workplace decision, what explanation the employer gave, whether that explanation changed, and how employees in comparable positions were treated. Our attorneys draw on more than 65 years of collective legal practice in matters involving discrimination, retaliation, wrongful termination, workplace harassment, and related disputes.

Records that may help establish the sequence and context include:

  • Emails, text messages, and internal workplace communications
  • Performance reviews, disciplinary notices, and personnel records
  • Job postings, promotion announcements, and termination notices
  • Compensation information and evidence of changed assignments
  • Internal complaints and the employer’s response
  • Notes identifying age-related comments, dates, participants, and witnesses

Preserve relevant employment records and communications in their original form. Don’t alter, annotate, or delete material connected to the dispute. Witness accounts and comparisons with younger employees in similar roles may provide additional context.

Filing With the CRD or EEOC: Deadlines & Next Steps

A claim under California law generally begins with a complaint to the California Civil Rights Department before a civil action is filed. A federal claim under the Age Discrimination in Employment Act generally begins with a charge filed with the Equal Employment Opportunity Commission.

A California Civil Rights Department complaint is generally subject to a three-year filing period. In California, the Equal Employment Opportunity Commission deadline may extend to 300 days for an age-discrimination charge. The applicable deadline can depend on the employer, legal claim, date of the challenged conduct, and other facts, so prompt review matters.

We assess the chronology, decision-makers, documents, witnesses, and employer’s stated reasons before discussing possible paths. Those paths may include an agency proceeding, negotiation, settlement discussions, or litigation.

  • “David and team have done an amazing job”

David and team have done an amazing job helping to secure a settlement due to my cessation of employment at a top firm. Thank you so much for your help.

  • “Highly Recommend”
Highly recommend. Laid off without notice by a shady Pre IPO lender in San Francisco. No one was given severance and they hired a labor attorney ahead of the layoffs to try and get around paying severance and warn notice. Without this firm taking my case, I would have never received a dime. Do not let a lay off without any severance deter you, contact this firm. Odd thing was 1 letter from this firm and severance was immediately offered. It's a game these high-tech companies are playing and gambling on. Their bet is 98% will not do anything severance and for the small percent that do, the amount to pay versus provided all in the layoff, is pennies on the dollar. Get your documentation, all emails, take photos of slack messages, record any zoom calls where there is a statement " no one is getting laid off" and so forth. Records any zoom calls where you are laid off. Take notes. Protect yourself and family. Working all the holidays and 12-hour days to be let go with nothing, is ridiculous. Use this firm and provide all your documentation. Good Luck!

  • “Extremely Satisfied”
I was referred to Ratner Molineaux after my daughter and I suffered injury and property damage resulting from a defective product in our home. During my very first conversation with David Ratner, I found him to be straightforward, professional, and extremely responsive to my concerns. Thereafter, David took the time to walk us through each and every stage of the litigation process and was an excellent advocate for my daughter and I. He remained fiercely protective of our interests and represented us well during mediation, preparation for trial, and settlement talks. David's style is very direct and to the point, which might be off putting for some, but worked well for me since I tend to be laser focused when dealing with business matters. Near the conclusion of my case, I had the opportunity to meet his partner Shelley, who had also diligently and effectively assisted with our litigation. In the end, our result was more than adequate, and both my daughter and I walked away extremely satisfied with both the representation we'd received, and the outcome of our claim. I definitely recommend this firm.
